Terms of Service

1. Acceptance of Terms

By creating an account or using StoreKin("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and StoreKin.

2. Description of Service

StoreKinis a multi-tenant e-commerce platform that enables artists, artisans, and creators ("Merchants") to create online stores, list products, and process payments. The Platform provides hosted storefronts, product management, order processing, and payment integration via Stripe.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. By using the Platform, you represent and warrant that you meet these requirements. Merchants operating within the European Union must comply with applicable EU regulations.

4. Account Registration

You must provide accurate, complete, and current information when creating your account. You are responsible for safeguarding your password and for all activity under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans and Billing

StoreKinoffers three subscription tiers: Starter (€9/month), Standard (€19/month), and Growth (€39/month). Subscriptions are billed monthly in advance via Stripe. You may upgrade or downgrade your plan at any time; changes are prorated. Failed payment attempts will trigger a grace period, after which your store may be suspended.

6. Merchant Obligations

As a Merchant, you agree to:

  • Sell only products you have the right to sell
  • Provide accurate product descriptions, pricing, and images
  • Fulfill orders in a timely manner
  • Comply with all applicable consumer protection and distance selling laws
  • Handle customer data in accordance with GDPR and applicable privacy laws
  • Not sell prohibited items (counterfeit goods, illegal materials, hazardous products)
  • Provide a valid return and refund policy to your customers

7. Payments and Stripe Connect

Payments are processed through Stripe. By using StoreKin, you agree to Stripe's terms of service. StoreKinuses Stripe Connect to facilitate payments from customers to Merchants. Transaction fees are set by Stripe and are the Merchant's responsibility.

8. Intellectual Property

Merchants retain full ownership of their content, product images, descriptions, and branding. By uploading content, you grant StoreKin a limited, non-exclusive license to display and distribute your content solely for the purpose of operating the Platform.StoreKinretains all rights to the Platform's software, design, and infrastructure.

9. Prohibited Content and Conduct

You may not use the Platform to:

  • Sell counterfeit, stolen, or illegal goods
  • Engage in fraud, money laundering, or deceptive practices
  • Upload malicious code or interfere with Platform operations
  • Violate the intellectual property rights of others
  • Harass, threaten, or discriminate against others
  • Circumvent tier restrictions or rate limits

10. Termination

You may close your account at any time through your dashboard settings. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your store will be deactivated. You remain responsible for any outstanding charges. We will retain your data for a reasonable period as required by law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, StoreKin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the fees paid by you to StoreKin in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your specific requirements.

13. Governing Law and Disputes

These Terms are governed by the laws of the European Union and the Member State in whichStoreKin is established. Any disputes shall be submitted to the competent courts of that jurisdiction. EU consumers retain the right to bring claims in their Member State of residence under EU consumer protection regulations. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. VAT and Tax Obligations

Merchants are solely responsible for determining and collecting any applicable VAT, sales tax, or other taxes on their sales. StoreKin does not act as a tax agent and does not collect or remit taxes on behalf of Merchants. EU Merchants must comply with applicable VAT regulations including the One-Stop-Shop (OSS) scheme for cross-border sales.

15. Modifications

We may update these Terms from time to time. We will notify you of material changes via email or through the Platform dashboard. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you disagree with changes, you may close your account.
